1st Alert: Requirements for an Arizona Prenuptial Agreement & Postnuptial Agreement to be Valid(Required)

An Arizona premarital agreement is not valid and enforceable unless the agreement is in a written document signed voluntarily by both parties after a fair and reasonable disclosure of each party's assets and debts. An Arizona Prenuptial Agreement becomes effective only when the parties actually marry each other, but not before. Under Arizona law, a properly drafted and signed Prenuptial Agreements & Postnuptial Agreements are enforceable without consideration if the parties marry.

2nd Alert: Assets & Liabilities Must be Disclosed(Required)

To be valid the agreement must accurately disclose all assets and liabilities of both parties. Our agreement contains exhibits on which each party lists their assets and liabilities. If you hire us you should immediately start making a list of your assets and liabilities and ask your future spouse to do the same. If a party's disclosure of assets or liabilities is materially incorrect a court could invalidate the agreement.

3rd Alert: Potential Problem from Elimination of Spousal Support(Required)

If a provision of a premarital or postmarital agreement modifies or eliminates spousal support and that modification or elimination causes one party to the agreement to be eligible for support under a program of public assistance at the time of separation or marital dissolution, a court, notwithstanding the terms of the agreement, may require the other party to provide support to the extent necessary to avoid that eligibility.

4th Alert: Each Party Must be Represented by an Arizona Attorney(Required)

To be a valid and enforceable Prenuptial Agreement or Postnuptial Agreement under Arizona law each party must be represented by an Arizona attorney. The attorneys cannot be in the same firm. Your future or current spouse can select any attorney he or she wants.
