In fact, on March 16, 2012, a Chronicle of Higher Education headline trumpeted their fundraising prowess — In Education: UCLA Endowment Is Fastest-Growing Among Major U.S. Schools — and on March 15, 2012, Bloomberg reported:

‘The University of California, Los Angeles endowment has grown the fastest among U.S. colleges since 2008 as markets recovered and gifts from philanthropists such as casino mogul Kirk Kerkorian surged.'

Well, Mr. Kerkorian and other donors, beware: once you’re gone, UCLA might just overturn the terms of your bequest if they deem such a move in their financial interests, despite having legally agreed to abide by your wishes and intent. That’s happening right now in the case of the Edward Carter bequest. And, he wasn’t just any donor — he was once chairman of the Board of Regents, and a Regent for 36 years.”

Inventor Sued By Pepsi Heirs To Release Formula

Estate of Denial:  Pepsico has no claim to “original, historically significant documents” about the invention of its signature soft drink, two brothers claim in Federal Court, claiming their father deserves the credit.

“By this action, the heirs seek to eliminate any doubt that original, historically significant documents belonging to their deceased father, Richard John Ritchie (‘Ritchie’), who is historically acknowledged as the person who developed the original, commercially successful formula for Pepsi-Cola on or about 1931 (the ‘Ritchie Invention’), are their personal property, as his lawful heirs, which they may freely share with historians, collectors, journalists, and television and film producers, and ultimately, members of the interested public, to tell their father’s extraordinary life story without interference or the threat of litigation from Mr. Ritchie’s former employer, Pepsi,” the complaint begins.”

Fight Over Profits From ‘Godfather’ Sequel

Estate of Denial:  “Proceeds from the sequel to Mario Puzo’s novel “The Godfather” published this week will be put in escrow while Paramount Pictures and the late novelist’s estate pursue litigation over the publishing rights.

An interim agreement allows publication of the novel to go forward, pending resolution of this matter,” Richard Kendall, a lawyer for Los Angeles-based Paramount, said at a hearing today in Manhattan federal court.

Paramount, a unit of New York-based Viacom Inc., sued Anthony Puzo, Mario’s son and the executor of his estate, in February to prevent the publication of a third sequel to “The Godfather,” claiming that it wasn’t authorized.”

Did A Judge And Lawyers Drain Rosa Parks’ Estate?

AZCentral:  The battle over Rosa Parks' estate has gone on for years.  Now, an attorney, Stephen G. Cohen, is accusing two attorneys and a judge of conspiring to drain the estate's cash.  The lawyers and the judge were involved in a long running civil rights dispute related to the estate.  Cohen alleges that the judge and attorneys racked up over $507,000 in unnecessary legal fees, leaving the estate $88,000 in debt.

When Rosa Parks died in 2005, she left most of her estate to the Rosa and Raymond Parks Institute which Cohen represents.  Parks' relatives challenged her will after her death.

Judge Rules Gary Coleman Did Not Have A Common Law Wife

Estate of Denial:  “Shannon Price failed to prove that she and Gary Coleman had a common-law marriage after their 2009 divorce.

Fourth District Judge James R. Taylor ruled Monday that while Price had lived in the former “Diff’rent Strokes” star’s home after their marriage ended, the relationship failed to meet the state’s standard for a common-law marriage.

“There is simply [insufficient] credible evidence to conclude that they were more than occasional roommates,” Taylor wrote in his 18-page decision.”

Reese Witherspoon’s Mother Tries To Annul Husband’s New Marriage

Estate of Denial:  “A lawsuit filed by the mother of Reese Witherspoon against the actress’ father is drawing attention to the plight of an aging population stricken with dementia who can be preyed upon by opportunists.

In January, John Drake Witherspoon, age 70, married Tricianne Taylor, who is 60, according to a certificate of marriage filed with the suit.

Problem is, says Mary Elizabeth “Betty” Witherspoon, who is trying to annul the new marriage she learned about from a wedding announcement in a newspaper, she and John never divorced.”

‘Explosive’ Diaries of James Brown’s Companion Subpoenaed

Estate of Denial:  “On Friday night former James Brown trustee, Adele Pope of Newberry, was served with a subpoena related to the diaries of Brown’s former companion, Tommie Rae Hynie.

Pope is being asked to turn over all written communications related to the Hynie diaries, including any communications with this reporter, any “blogger, website or media outlet.”

The Observer has requested a copy of the diaries from Attorney General (AG) Alan Wilson under the Freedom of Information Act (FOIA), but the request was refused in March.

In a telephone interview in November, 2011, a longtime friend of music icon James Brown characterized the Hynie diaries as ‘explosive.'”

California Appeals Court Rules For Same Sex Partner in Estate Case

Estate of Denial:  “The California Court of Appeal established an important new legal protection for unmarried partners who are wrongfully prevented from inheriting property from each other when one partner dies. The Court of Appeal ruled in favor of the surviving same-sex partner of a deceased Southern California man in a lawsuit alleging that the deceased partner’s sister had intentionally prevented him from signing a will that would have left a share of his property to the surviving partner. The two men were not married and were not registered domestic partners, but had been in a committed relationship for nearly ten years.

The surviving partner, Brent Beckwith, filed the suit against his deceased partner’s sister, Susan Dahl, after the Los Angeles Superior Court ruled in a probate proceeding that Beckwith had no right to any share of his partner’s property because he had died without leaving a will and the couple were neither married nor registered as domestic partners. California law allows registered same-sex partners to inherit property in the same way as spouses, but provides no inheritance rights to couples who have not registered as domestic partners if one of them dies without a will.”

EMI Music May Lose Rights to ‘Pint Panther Theme’

Estate of Denial:  EMI Music could lose its grip on one of the most famous pieces of film music ever created — “The Pink Panther Theme,” written by the late Henry Mancini for the 1963 film.

Late last month, Mancini’s publishing company, Northridge Music Inc., controlled by the composer’s heirs, filed a claim at the American Arbitration Association that seeks more than $1.35 million in unpaid “net profits” on music for The Pink Panther film. The heirs are also seeking punitive damages and want EMI’s administration rights terminated due to alleged malfeasance and breach of fiduciary duty.”

Struggle Over Archie Comics Empire Underscores Need For Estate Planning

Probate Lawyer Blog:  “The New York Times recently featured a fascinating article called The Battle for a Comic-Book Empire That Archie Built. It detailed the ongoing legal battle over the two dueling CEO’s of Archie Comic Publications.

On one side is Jonathan Goldwater, the son of John L. Goldwater who was one of three founders of the company and the visionary behind the Archie character, created in 1941. Goldwater became a co-CEO and controller of one-half interest in the company after his half-brother, Richard Goldwater, died in 2007.

Nancy Silberkleit is the widow of the son of another founder, Louis Silberkleit. She was a schoolteacher who became co-CEO when her husband, Michael Silberkleit, died in 2008. By that time, a long-time employee and editor-in-chief, Victor Gorelick, was running the company as a temporary, stop-gap measure.

Goldwater and Silberkleit tried to work together to manage the company, agreeing in 2009 to run Archie Comics by sharing CEO duties. Silberkleit was to oversee scholastic and theatrical ventures, placing Goldwater in charge of everything else. They were supposed to consult with each other on major decisions.”

Trial Starts Today For Gary Coleman Estate

Estate of Denial:  “The battle for the estate of Gary Coleman will hit a Provo courtroom today in a two-day trial that pits the late actor’s former wife against the head of Coleman’s corporation.

The case hinges on whether Coleman and his former spouse, Shannon Price, continued living as husband and wife even after their 2008 divorce until Coleman’s death on May 28, 2010.

The head of Coleman’s corporation, Anna Gray, of Portland, has a 2005 will signed by Coleman naming her as the executor and beneficiary to his estate.

Price claims that Coleman had a handwritten codicil, or amendment, to the will in 2007 that gives all assets to her, including their $315,000 home in Santaquin.”

Ray Charles Foundation Sues Ray Charles’ Kids

Estate of Denial:  “The Ray Charles Foundation seeks as much as $3.5 million from seven of the late singer’s 12 children, whom the foundation claims, in Federal Court, were unhappy with their inheritance and wrongly terminated the transfer of copyrights to dozens of Charles’ songs to the foundation.

Ray Charles’s legacy and estate has been the subject of acrimony and litigation almost since the moment the singer died of liver disease in Beverly Hills, in June 2004. The string of lawsuits that followed revolved around the rights to – and proceeds generated by – recordings, photos and film images of the star.

According to the latest lawsuit, from lead plaintiff Raenee Robinson, Ray Charles gathered most of his 12 children — including five of the seven defendants (two were then incarcerated) – in Los Angeles in December 2002 to tell them what he intended to provide for them upon his death.”

Will Battle Over Lee Harvey Oswald’s Tombstone

Estate of Denial:  “A small Illinois museum is being threatened with a lawsuit after it was revealed to be the home of Lee Harvey Oswald’s tombstone, the sniper who assassinated President John F. Kennedy in 1963.

It has cropped up at Wayne Lensing’s Historic Auto Attractions museum in Roscoe among other historical artifacts including Elvis Presley’s 1972 Lincoln, the Mayberry squad car from The Andy Griffith Show and three Batmobiles.

To the unwitting visitor the tombstone fits right into the quirky museum, around the corner from Richard Petty’s 1960 stock car and a few steps from a Cadillac covered in 120,000 coins.

But the story of the 130-pound granite slab is shrouded in mystery.”

Nurse Will Probably Get Most of Huguette Clark’s Estate

Estate of Denial:  “The Upper East Side properties owned by the late heiress Huguette Clark hit the market early this month and her Filipina nurse will receive the bulk of the sale.

Edwin Josue, a Filipino real estate broker of Halstead properties, explained that 62-year-old Filipina nurse Hadassah Peri will benefit the most from the sale of Clark’s properties.

The New York Times reported that based on Clark’s second will, Peri will receive 60 percent of the multimillionaire’s various assets, worth about $40 million, including investments and much of her real estate holdings not specifically bequeathed in the will.”

The Story of Disinherited Heirs

Vitals on MSNBC:  “Some do it with malice. Others, through a misguided notion that money or family heirlooms don't really matter to the person. Whatever the reason, the plight of the disinherited — or those who may be cut out of the family wealth in the future –has been highlighted by a bitter legal battle between Australia’s “richest mom,” Gina Rinehart, and her three children.

The billionaire says it would be in the “best interests of the beneficiaries to force them to go to work” rather than let them inherit her mining empire.

Then there's Mary Beth Caschetta, whose father cut her out of his will in dramatic movie star style.

“There was a line in my father's will similar to what Joan Crawford used when she disinherited her daughter,” says the 45-year-old medical writer and author from Massachusetts. “‘I leave no bequest to my daughter for reasons known to her.'”

SC AG Refuses Freedom of Information Act Requests For James Brown Documents

ABA Journal: The Freedom of Information Act (FOIA) requires every public official to release public documents within 15 business days of an FOIA request. The government official is required by law to comply, whether the request is made by the press or by the public. The office of the Attorney General (AG) has the responsibility of enforcing the law.

Ironically, it is that very office which has fought for eight months to dodge and delay every FOIA request submitted by Newberry resident and former James Brown trustee Adele Pope.

Among the FOIA requests Pope filed last summer with the AG’s office:

1) Pope asked for a copy of the Legacy Trust. This is the trust created by former AG Henry McMaster when he took over Brown’s $100 million music empire in the 2009 settlement deal with six of Brown’s alleged children and his companion, Tomi Rae Hynie.

2) Pope requested documents related to why the Legacy Trust trustee, who was appointed by McMaster and serves at Wilson’s pleasure, valued the music empire of legend James Brown at less than $4.7 million upon his death on Dec. 25, 2006. (For several years, Brown had earned royalties of $4-5 million a year.)

Zsa Zsa Gabor’s Husband Responds to Conservatorship Request

Estate of Denial:  The feud between Zsa Zsa Gabor‘s ninth husband, Frederic Prinz von Anhalt, and her only daughter, Constance Francesca Hilton, has once again been ignited. On Tuesday, March 20, Hilton filed for conservatorship over her mother’s finances and medical care, leading von Anhalt to hold a press conference at hi shome.

Reacting to Hilton’s conservatorship request, von Anhalt told reporters, “My wife doesn’t complain. She says she’s in a good condition, she feels good.” The 68-year-old added that Hilton is picking on him “at the worst times,” explaining, “We are right now going through a very hard time, my wife and me. We have to sell our property in order to pay our debts. My wife has $6 million in debts.”

In her petition, Hilton questioned why von Anhalt took out a $700,000 loan on Gabor’s $10 million Bel Air mansion, which reportedly is in foreclosure. While von Anhalt admitted to borrow the money, he said the debt was caused by Hilton who wrongfully refinanced the house years ago.

Court Assistance Requested in Zsa Zsa Gabor Case

Estate of Denial:  The judge who oversees Britney Spears’ conservatorship will consider a request to appoint a conservator to oversee Zsa Zsa Gabor’s finances and medical care.

Los Angeles County Superior Court Judge Reva Goetz scheduled a hearing for May 2 for the conservatorship petition filed Tuesday by Francesca Hilton, Gabor’s daughter.

The Hungarian-born actress was once one of Hollywood’s most glamorous women, but a broken hip and leg amputation in the past two years have left her confined to a bed.

Hilton contends that Gabor’s ninth husband, Prince Frederic von Anhalt, is keeping her “increasingly isolated” and “heavily sedated,” and she questions his handling of Gabor’s finances.

“What Ms. Hilton is seeking here is for the court to make sure that Zsa Zsa’s best interests are not being sacrificed for the selfish interests of anyone involved in Zsa Zsa’s life,” said Hilton lawyer Kenneth Kossoff.

Details on the Deal to Settle Rosa Parks’ Estate

Estate of Denial:  The secret legal agreement designed to settle the brawl over the estate of civil rights leader Rosa Parks is a secret no more.

The confidential seven-page document — signed by Parks’ 15 nieces and nephews, Parks’ longtime friend and caregiver Elaine Steele and an official of the institute Parks and Steele founded — turned up in a Jan. 18 filing with the Michigan Supreme Court.

The agreement — struck during a late-night bargaining session in February 2007 in order to avert a trial in Wayne County Probate Court — spells out how the parties are to divvy up the proceeds from the sale of Parks’ belongings, said to be worth up to $8 million because of their historic value.

Under the agreement, Steele and the Rosa and Raymond Parks Institute for Self Development will get 80% of the net proceeds from the sale of Parks’ possessions, as well as the royalties from licensing her name, image and likeness. The nieces and nephews are to get 20%.
